Terms of use
Last updated 21 October 2026
These terms are the agreement between you and Habitax, run by Peter Solly, a sole trader in the United Kingdom ("we", "us"). By saving a card or using the app, you agree to them. Please read the section on charges carefully, because Habitax takes real money when you miss.
1. Who can use Habitax
You must be 18 or over and have a payment card in your own name. Habitax is for personal use.
2. How the daily check-in works
- Each day, the app asks whether you did your habit. You answer Yes or No.
- A day counts as a miss if you answer No, or if you haven't answered by 12:00 noon UK time on that day.
- Not answering counts as a miss even if your phone was off, out of signal, or notifications were turned off. You agree to this when you set up a habit.
- Answers are timestamped when you tap them. If your tap couldn't reach us because you were offline, the time on your phone is used.
3. Charges
- Each miss costs £1, or the amount you chose if you have Premium. The amount is shown in the app before you save your card.
- We add up your misses and charge your saved card once a month, on the 1st, for the month before. We email you the total a few days before.
- If a charge fails, we'll try again on the 3rd and the 5th of the month.
- If you think a miss was recorded wrongly, email support@habitax.app before the charge and we'll correct it. After the charge, we'll refund misses that our app recorded in error.
- You can remove your card at any time. Misses already recorded for the current month will still be charged.
4. Where the money goes
For every £1 you're charged, we donate 70p to charity. We keep 30p to cover card fees and the cost of running Habitax. We pay donations over within 28 days of the end of each month, and show the receipts in the app.
Penalties are payments to Habitax that we donate on. They aren't donations from you, so you can't claim Gift Aid or tax relief on them.
5. Premium
Premium is a monthly subscription bought through the App Store and billed by Apple. It renews automatically until you cancel it in your Apple account settings. Apple handles Premium refunds under its own rules.
6. Your right to cancel
When you subscribe to Premium you're asking for it to start straight away, so you agree that the usual 14-day cooling-off period doesn't apply once you've started using it. This doesn't affect your rights under the Consumer Rights Act 2015 if Habitax isn't as described.
7. Our responsibility to you
We'll do our best to keep Habitax working, but we can't promise it will always be available or free of errors. If the app fails in a way that causes you to be charged wrongly, we'll refund you. We're not responsible for losses we couldn't reasonably have foreseen. Nothing in these terms limits liability that the law doesn't allow us to limit.
8. Ending your account
You can delete your account at any time in the app. We may close an account if it's being used for fraud or to abuse the service, and we'll tell you why.
9. Changes to these terms
If we change these terms, we'll tell you in the app at least 14 days before the change applies to charges. If you don't agree, you can remove your card and delete your account.
10. Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
